Fired Employee Wins Settlement for Wrongful Termination

If you are employed in California, the company you work for has a responsibility to provide fair treatment to you and all employees. Companies cannot discriminate against people on basis of religion, gender, race, sexual orientation, or age, as well as people who are disabled or pregnant. When people are not treated fairly or are terminated on questionable grounds, they may be able to file a lawsuit against their employer. A fired employee wins settlement for wrongful termination if they can prove the dismissal was due to discrimination, retaliation, or other unlawful practices.

This is what happened to a woman who filed a claim against her employer after she was fired because she gave a customer an improper markdown. Yet, the woman claimed that the actual reason she was fired stems from her disability, medical conditions, and her age. As the oldest employee in the department, she felt as though she was unfairly treated in comparison to other employees in the store. The jury presiding over the case determined that the company did not accommodate the woman’s disability by putting her in a position where she was made to lift heavy objects and stand for long periods of time. They also determined that the woman experienced retaliation after reporting wrongful sales practices in the store. The woman was awarded a settlement of $175,500 for these reasons.
